By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

1. Who We Are

The Site is owned and operated by DuctArmor (“DuctArmor,” “we,” “us,” or “our”), a provider of in‑slab and in‑ground air duct coating, sealing, and related products and services.

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.

By using the Site, you agree that you will not:

  • Use the Site in any way that violates applicable laws or regulations.

  • Attempt to gain unauthorized access to any part of the Site, other accounts, computer systems, or networks.

  • Use any robot, spider, or other automated device to access the Site for any purpose without our prior written consent.

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties.

3. Information on the Site (No Professional Advice)

Content on the Site is provided for general informational purposes only and relates to air duct systems, restoration, and DuctArmor products and services. It is not intended as professional HVAC, environmental, or construction advice and should not be relied upon as such.

You are responsible for consulting with qualified professionals or local DuctArmor dealers regarding your specific situation before making decisions or taking action based on information on the Site.

4. Dealer Network and Third‑Party Providers

DuctArmor products and services are often delivered through independent dealers and contractors who are not employees or agents of DuctArmor.

  • We may help connect you with information about nearby DuctArmor dealers based on the details you provide.

  • Any services performed at your property (such as inspection, cleaning, or coating) are typically provided by an independent dealer under a separate agreement between you and that dealer.

  • We are not responsible for, and do not control, the actions, omissions, pricing, or performance of independent dealers or contractors.

You should perform your own due diligence and review any estimates, contracts, or warranties provided by the dealer.

5. Quotes, Estimates, and Orders

Any quote or estimate you receive through or in connection with the Site is provided for informational purposes only and is not a binding offer until confirmed by DuctArmor or the applicable dealer.

We reserve the right to correct any errors or omissions and to modify or withdraw any offer, product description, or pricing at any time without prior notice.

If you purchase products or services through the Site or from a dealer:

  • Additional terms and conditions (such as invoices, warranties, or dealer agreements) may apply.

  • If there is a conflict between these Terms and a written agreement signed by you and DuctArmor or a dealer, that written agreement will typically govern as to that transaction.

6. Intellectual Property

All content on the Site, including text, graphics, logos, icons, images, videos, and software, is owned by DuctArmor or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may:

  • Access and view the content on the Site for your personal, non‑commercial use.

You may not:

  • Copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any content obtained from the Site without our prior written consent.

  • Use any DuctArmor trademarks, logos, or branding without our prior written permission.

7. User Submissions and Feedback

If you submit or upload any information, content, questions, reviews, photos, or feedback to us through the Site, email, SMS, or other channels (“Submissions”):

  • You represent that you own or otherwise have the right to provide the Submissions.

  • You grant DuctArmor a non‑exclusive, worldwide, royalty‑free, perpetual, irrevocable license to use, reproduce, modify, and display such Submissions in connection with operating, marketing, and improving our products and services, subject to our Privacy Policy.

We are not obligated to use or respond to any Submissions and may remove them at our discretion.

8. Privacy and Communications (Including SMS)

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Site, you consent to our data practices as described in the Privacy Policy.

If you provide your phone number and consent to receive SMS/text messages:

  • You agree that we (and our SMS service providers acting on our behalf) may send you messages regarding your inquiries, nearby dealer information, appointments, service updates, and occasional promotions.

  • Message frequency may vary; message and data rates may apply.

  • You can opt out at any time by replying STOP to any SMS message, or by contacting us using the information in the “Contact Us” section.

You understand that your consent to receive SMS messages is not a condition of purchase.

No sale or sharing of mobile opt‑in data:

  • No mobile information will be shared with third parties or affiliates for their marketing or promotional purposes.

  • Text messaging originator opt‑in data and consent will not be sold, rented, or shared with any third parties, except as necessary to provide the text messaging services (for example, to SMS aggregators and providers that deliver messages on our behalf).

If our Terms or Privacy Policy elsewhere describe categories of information that may be shared with third parties, all such categories exclude text messaging originator opt‑in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text message services.

We are not responsible for the content, policies, or practices of any third‑party websites. Accessing any third‑party websites is at your own risk and may be subject to different terms and privacy policies.

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, DUCTARMOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

  • THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE;

  • DEFECTS WILL BE CORRECTED; OR

  • THE CONTENT ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.

ANY USE OF THE SITE OR RELIANCE ON ANY INFORMATION OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DUCTARMOR OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID (IF ANY) TO US DIRECTLY THROUGH THE SITE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless DuctArmor and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use of the Site;

  • Your violation of these Terms; or

  • Your violation of any rights of another person or entity.

13. Changes to the Site and Terms

We may update or change the Site from time to time, including adding or removing content, features, or functionality, without notice.

We may also update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after any changes to the Terms constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Site.

14. Governing Law and Dispute Resolution

These Terms and your use of the Site are governed by the laws of the State of Oklahoma, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Site will be resolved:

  • First, through good‑faith negotiations between you and DuctArmor; and

  • If not resolved, then in the state or federal courts located in Oklahoma, and you consent to the exclusive jurisdiction and venue of such courts.

Nothing in this section limits any rights you may have under applicable consumer protection laws.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms or agreements that expressly reference these Terms, constitute the entire agreement between you and DuctArmor regarding your use of the Site and supersede all prior or contemporaneous understandings or agreements on that subject.
